Course abstract

The aim of the study course is to provide students with the necessary knowledge about the historical and modern State Real Estate Cadastre System of the Republic of Latvia, its goals and tasks. Within the framework of the program, students are introduced to information systems that ensure unified processes and the formation of real estate in the Republic of Latvia.
The program is focused on the comprehensive preparation of cadastral specialists (land surveyors) working at various levels of the State Land Service (hereinafter - SLS), state and local governments. The program development uses the SLS requirements regarding the knowledge required by new cadastral specialists and their cooperation with the state, local governments and other legal entities (including notaries, sworn bailiffs, lawyers). The knowledge acquired during the study process can be used in work at the SLS, other state institutions, local governments, as well as in private business.

Learning outcomes and their assessment

After completing the course, students:
- are familiar with the history, nature, content of the cadastre, the necessity and use of cadastral information (assessment based on the results of laboratory work and independent work)
- are able to independently perform the activities of obtaining, compiling, and registering real estate cadastral information (assessment based on the results of control work, laboratory work, and independent work) - are able to process and evaluate the obtained results in cooperation with the course leader (assessment based on the results of laboratory work and independent work).

Course Content(Calendar)

Full-time attendance:
1.Introductory lecture. Real estate cadastre and its role in Latvia. Basic criteria set by the curriculum. Get acquainted with the structure, goals and strategy of the State Property Service (1.5 h).
2.Historical establishment of the cadastre in Latvia and its role in real estate management (2 h).
Practical work: Get acquainted with the portal www.kadastrs.lv and https://vesture.dodies.lv. Compare data sets, describe differences for a specific administrative territory in different cadastral periods (1.5 h).
3.Modern NĪVKIS and its role in real estate management in the territory of Latvia (2 h).
Laboratory work: Get acquainted with the portal www.kadastrs.lv and the SLS website. Compare publicly available data sets, describe information about a specific administrative territory (1 h).
Practical work: View and evaluate open data on the portal www.kadastrs.lv and its significance for the needs of society (1 h)
4. Administrative act and its components, on the basis of which the NĪVKIS cadastral object register and cadastral data are updated (2 h).
Laboratory work: get acquainted with the decisions made by local governments and state institutions during the land reform, on the basis of which NĪVKIS data is updated (1 h).
5. Real estate cadastral objects: legal objects and physical objects (2 h).
Practical work: Find real estate on the portal www.kadastrs.lv and provide their characteristics (1 h).
6. Cadastral object identifiers (cadastral numbers and cadastral designations) (1.5 h).
Cadastral object – data characterizing land units and parts of land units: purposes of use of real estate, types of land use and real estate encumbrances (6 h).
Practical work: Search for land units according to their legal status on the portal www.kadastrs.lv and provide their cadastral characteristics (0.5h).
Laboratory work: Prepare a municipal decision on determining the purpose of use of real estate and its division by land use type (2 h)
Recognize the land use types depicted on the situation plan and compile a list of explanations of land use types (1.5 h).
Recognize the real estate encumbrances depicted on the encumbrance plan and prepare a list of encumbrances with occupied areas (1.5 h).
7. Real estate encumbrance – easement according to the Civil Law. Data registration and updating in the NĪVKIS and the Land Register (2 h).
Practical work: Prepare an agreement with a graphic appendix for the establishment of a road easement (1.5 h).
8. Cadastral object – volume indicators characterizing the group of buildings and premises: building classifier, main type of use, improvements, depreciation and data acquisition from the Construction Information System (4 h).
Practical work: Search for buildings (residential, non-residential and engineering structures) on the portal www.kadastrs.lv, provide their cadastral characteristics (1 h).
Laboratory work: Prepare a declaration of a building or engineering structure with a graphic appendix for registration in NĪVKIS (1 h).
9. Cadastral object – land property, building (structure) property and apartment property. NĪVKIS property registration/update principles in the territory and land register of the Republic of Latvia (4 h).
Laboratory work: Search for land, building (structure) and apartment property on the portal www.kadastrs.lv and provide their cadastral characteristics (2 h).
Practical work: Prepare a request for confirmation of property registration in the Land Register and NĪVK IS (1.5 h).
10. Possibilities and principles of forced termination of shared ownership. Registration of alienable land in NĪVKIS (1h).
Laboratory work: Search for shared properties on the portal www.kadastrs.lv and determine the functionally necessary area. (2h).
11. Building rights, their impact on economic activity and registration in NĪVKIS (0.5h).
Laboratory work: Prepare a building rights agreement with a graphic appendix for registration in NĪVKIS (2 h).
12. NĪVKIS data for real estate tax administration (0.5h).
Laboratory work: Calculate the notional shares when dividing a residential building into apartment properties (1h).
13. Use and exchange of NĪVKIS data in connection with other state information systems (2h).
14. The role of land registers in strengthening and protecting property rights (1h)
Laboratory work: Get acquainted with the public information of the land register on the registration of real estate (1h).

Part-time correspondence:
All topics indicated for full-time correspondence are implemented, but the number of contact hours is 1/2 of the indicated number of hours.

Requirements for awarding credit points

The exam grade consists of:
successfully mastered lecture material, completed all laboratory and independent work that is assessed (point system 4-10);
test results;
class attendance.
The exam is taken in the form of an oral or test:
- positive assessment of exam questions - positive assessment of exam test.

Class attendance of not less than 75%. Practical and laboratory work submitted and successfully assessed within the specified time. For work that is assessed with a grade and submitted after the specified time (if there is no justifiable reason), the grade is reduced by 1 point.

Description of the organization and tasks of students’ independent work

Throughout the semester - study of scientific and study literature (monographs, scientific articles and their collections, conference and seminar materials, specialized scientific periodicals) specified by the lecturer necessary for mastering the professional competencies of the study course “Cadastre”

Independent work before each lesson - 4.5 hours.

The results of independent work are presented - as a result of presentations of no less than 10 slides. Laboratory works are submitted in Word or Excel format, in accordance with the given assignment, but not less than 1 page.

2. Describe the norms of the Civil Law and the Real Estate State Cadastre Law (hereinafter – the Cadastre Law) regarding real estate
3. Describe the norms of the General Provisions of the Cadastre Law
4. Describe the norms of the Cadastre Law regarding the identification system of cadastral objects and subjects
5. Preparation for the test
6. Describe the norms of the Cabinet of Ministers regulations regarding types of land use in accordance with the documents submitted or prepared by the State Land Service.
7. Describe the norms of the Protection Zones Law, etc. regarding encumbrances and their registration from the Encumbered Territories Information System. 8. Describe the norms of the Cabinet of Ministers' regulations regarding the purposes of use of real estate for land units, parts of land units, types of use of buildings and groups of premises and their impact on cadastral values
9. Describe the norms of the Cadastre Law regarding the registration or updating of cadastral objects and data exchange with other information systems maintained by the state and local governments
10. Describe the norms of the Cadastre Law regarding the creation of real estate in the Cadastre Information System and the Land Register
11. Describe the norms of the Cadastre Law regarding the storage of cadastral documents and cadastral data
12. Describe the norms of the Cadastre Law regarding the registration of text data
13. Describe the norms of the Cadastre Law regarding the registration of spatial data
14. Describe the norms of the Land Register Law regarding the consolidation of property rights
15. Describe the norms of the Law "On Real Estate Tax" regarding the administration of property tax
16. Describe the norms of the Cadastre Law regarding the receipt of necessary information and the issuance of cadastral information

17. To describe the provisions of the Cadastre Law and the Cabinet of Ministers regarding the termination of forced division of property in the territory of the Republic of Latvia.

Criteria for Evaluating Learning Outcomes

Study results in the 10-point system are evaluated according to the following criteria:
1. A successful grade for the results of the test is obtained if at least 50% of the questions are answered correctly
2. The assessment of laboratory work depends on the volume and quality of the work performed
3. The assessment of the results of independent work depends on the volume and quality of the arguments presented in the discussion
4. In the exam, which takes place orally, in public, in the presence of all students of the course, the answers given to the exam questions are discussed in a public discussion
5. The assessment of the exam depends on the assessment of the results of the exam test, test work, laboratory work and independent work, as well as on the cumulative assessment of class attendance
6. A successful grade is obtained in the exam if:
- when answering the exam questions, the student demonstrates knowledge and critical understanding of the need and use of cadastral information, whether he has acquired skills in independently obtaining, compiling, registering real estate cadastral information, and whether he is able to process and evaluate the obtained results
- a positive result is obtained for the exam test, test work, laboratory work and assessment of the results of independent work - at least 85% of class attendance has occurred
